Sunil Khanna, Head of the Criminal Department was instructed to represent a client facing a charge of assault. It was alleged that the client and another had assaulted the victim late at night for no reason. The client had always maintained his innocence and rightly entered a Not Guilty plea to the charge. The client would be arguing that he was actually stopping the fight, not getting involved in it. On the day of trial, the complainant failed to attend the hearing. The prosecution applied to adjourn the case, which was strongly opposed by Mr. Khanna. The District Judge agreed with Mr. Khanna and refused to adjourn the case, leaving the prosecutor with no choice but to offer no evidence against the client and the charge was dismissed by the Court.
