Building Disputes for Homeowners

Building Disputes for Homeowners

Ringrose Law fields a dedicated team of experienced property litigators dealing with all aspects of building disputes and construction disputes. Such disputes regularly involve a client’s home and the provision of sensible practical legal advice from an early stage is essential in managing and indeed sometimes avoiding any building disputes that may arise.

Our dedicated team has substantial experience in advising on and conducting claims arising out of building and construction work.
We understand that, irrespective of the amount of money involved, building disputes can rapidly become stressful, time-consuming and expensive.

We provide to our clients a professional friendly service and will give you honest advice regarding your actual legal position at an early stage. We can advise whether you have a claim or a defence and/or counterclaim.

Examples of building disputes

Examples of building disputes that we have dealt with and are able to provide you with advice on include:

  1. Disputes with your builder;
  2. Party Wall Act Disputes;
  3. Building Disputes with your neighbour.

I am the home owner

We appreciate that many times an agreement to start work is reliant on a verbal agreement or a handshake.

This informal approach can sometimes give rise to building disputes. Alternatively, we can consider and unpick unclear or unfair terms in building contracts or decide exactly what your builder has agreed to do or what work isn’t covered.

We have many cases and equally act for either the home owner or builder.

If you have had work carried out at your home then you will know that it is potentially a risky business. Even the best contractors can make mistakes. You may have concerns that the work that you have had done may be of defective or insufficient quality.

You may have been left with remedial works being required. What should you do if the work has not been completed on time or you have been overcharged for the work undertaken? Can you get your money back or are you entitled to damages?

Informal and formal attempts to settle the dispute by negotiation should be tried first and we can help you take those steps as well as taking your claim to court in appropriate cases.

I am the builder

We have acted for builders, from small traders to large companies, to help them recover the monies that they are owed for building works that they have undertaken on behalf of their customers. We can also help if you have been asked to leave site or stop work.

Or if there is a claim against you but the client kept on changing the specification or the architects design was wrong.

What is the correct course of action to take if a client states that they are unhappy with your work and refuses payment?

Small disputes can easily lead into expensive litigation if you chose to do nothing. An unhappy customer can lead to cash flow problems for your business or damage to your reputation.

There are many different ways to resolve building disputes without court proceedings and we would initially seek to open lines of communication between the parties. We can advise on and represent you at round table meetings, mediation, arbitration and adjudication hearings.
