Bullying and Harassment

Case Study

Ms X was employed by a large national retail outlet. She was incredibly passionate about her job and was well liked by both her colleagues and customers. After a while, Ms X she started to become isolated by one of her colleagues. At first she tried to ignore the isolation, but the treatment got worse until Ms X was actually being bullied at work. Unfortunately, the employee responsible for bullying Ms X was also a very close friend of the senior manager. For this reason, Ms X was scared to raise her concerns. Eventually, things became so difficult for Ms X she felt she had no option but to report her concerns to her senior manager. In response and in front of all her colleagues, Ms X was shouted at and humiliated. Ms X was devastated and did not know what to do.

When she called Ringrose Law we immediately arranged for her to attend a Fixed Fee Interview to see what we could do to help her. Throughout the appointment it was clear that Ms X loved her job, but she could not envisage any return to work: her employers had made things so unpleasant and unbearable for her. We helped Ms X through the grievance procedure and then submitted a claim of Constructive Dismissal to the Employment Tribunal on her behalf. Ms X funded her claim by legal expenses insurance which was attached to her home insurance policy. She therefore had no legal costs to pay herself.

We represented Ms X throughout proceedings and the matter was heard in the Employment Tribunal. Ms X was successful in her claim for Constructive Dismissal and received the compensation she deserved. Ms X was delighted with result that we had managed to achieve for her and we were very happy to help.

Bullying and harassment can take many forms, including: making derogatory comments, criticism, unwanted banter, assault, verbal or physical threats, humiliation in public, making unjustified criticism etc.

If you are being bullied or harassed on the grounds of your race, age, religion or belief, age, disability, sexual orientation, then it is likely that you are the victim of unlawful discrimination. If you are being bullied or harassed for another reason, there are steps you can take to protect yourself, such as by lodging a grievance under your employer’s grievance procedure. In certain circumstances, including where your employer does not deal with your grievance properly, you may be able to resign and claim Constructive Unfair Dismissal.
