Breach of PUWER leads to serious hand injuries for stockman

Norfolk Free Range Limited has been fined for safety failings after an employee suffered serious injury to his hand.

The employee, a stockman, was shovelling feed into neighbouring troughs after a failure in the automated system had caused an overflow in the distribution of feed pellets. He used his hand to sweep the feed off the top of the machinery where it had built up and at that moment the machine started automatically and pulled his finger into the auger severely injuring it.

The Company was fined a total of £12,500, after pleading guilty to an offence under Regulation 11(1) of the Provision and Use of Work Equipment Regulations 1998 (PUWER).

As an employee, if you feel that a situation at your workplace is unsafe then inform your supervisor and the health and safety officer. You could also inform a Union representative, if one is available.

If you are in an accident at work, it may not be at the fault of your employer, however if it could have been avoided then you may have a claim for personal injury.
