The 1980 Hague Convention on the civil aspects of international child abduction is a treaty which seeks to protect children from the effects of abduction or retention across international boundaries by providing a very clear procedure to bring about their prompt return to their home country (their habitual residence).

Cases brought under the Hague Convention are very different to those in the UK Courts looking at where a child should live, and save in exceptional circumstances the Convention starting point is that it is in the child’s best interests to be returned quickly.

Over 70 countries are members of the Convention and each country that is party to it has a designated Government Office known as the Central Authority and its duty is to send and receive requests for the return of children or the enforcement of orders.

Under the Hague Convention if your child has been taken into another signatory country in breach of your custody rights or your child has been retained in another signatory country in breach of your custody rights, or you have not been able to secure access to your child who is living in another signatory country, you can make an application.

There are certain conditions that you have to meet which are quite complicated and here at Ringrose Law we are able to advise on your individual circumstances.

Under the provisions of the Hague Convention you are not required to make any payment towards these costs and it will be covered in this country in the UK under Legal Aid.

The most important aspect of these cases is that any application must be made as soon as possible. Speed and urgency is absolutely crucial.

Any aim of any proceedings issued is to deal with them within 6 weeks from the start of the proceedings and cases should not take any longer, taking priority in the High Court to be dealt with.
