Tony Freitas from our Lincoln crime department recently represented a young man, Mr H, accused of assaulting a police constable in the execution of his duty.  He pleaded not guilty and his case was adjourned for trial.  On the day of trial, the police officer in question gave evidence that Mr H had bitten him while he was being restrained in the police van.  He was adamant that Mr H had bitten him on his arm.  Mr H also gave life evidence at his trial, stating that there was no way he would have bitten anybody, let alone a police officer.

Tony Freitas cross examined the police officer about his evidence, and put Mr H’s version of events to him.  The magistrates considered Mr H’s case and gave their judgement, stating in their opinion that they could not be sure that the bite took place as alleged.  Mr H was therefore found not guilty of assaulting the police officer.

Mr H was very grateful for the representation he received throughout the whole case, especially during the trial.  He had always maintained his innocence, and through the trial excellence of Tony Freitas, his reputation remained unblemished.
