In September 2014, The Common’s Justice Committee heard that Litigants in Person are not getting fair hearings.
This follows the withdrawal of Legal Aid courtesy of the ‘Legal Aid Sentencing and Punishment of Offenders Act 2012’, in April 2013 which removed Public Funding for most Private Law Family Cases.
Since then the number of people forced to represent themselves in Court in family cases has increased dramatically, increasing the time to resolve disputes.
What is needed is legal advice to focus cases at an early stage.
There is also concern about a growing trend of commercial McKenzie Friends, unqualified, untrained and unregulated who owe no professional duty to the Court or the client and a low number of cases that have been granted exceptional funding.
If you have any personal experiences of this nature please contact any of our Specialist Team who will endeavour to assist or attend any of our free family law clinics which are held at all our offices at Boston, Lincoln, Grantham, Sleaford, Spalding or Newark on the last Friday of every month.
