An 83 year old business man has been jailed for 14 months for “serious content” after his ex-wife was awarded millions in their divorce settlement.

The Judge remarked

“He is a man who has received repeated warnings already that he must comply with Court Orders and he has chosen, repeatedly, not to do so”.

He was ordered to transfer shares in his company to his wife and he has done his upmost to frustrate her ability to run it efficiently and effectively.

The Judge commented that although both parties funded their own legal costs the Courts in which this unnecessary protractive litigation has been fought out for the past 6 and a half years and all those working within it (including the Judge himself!) are funded from the public purse.  The case had placed immense burden on limited public funds, “a burden that will now continue as a result of your incarceration”.

The Judgement is a timely reminder that irrespective of the amount of money involved where Court Orders in divorce cases are persistently and deliberately breached, the Court has very forceful powers to ensure Orders are enforced.
