It has not been missed by all here at Ringrose Law that there has been a huge rise in the waiting time of Court activity. Whether it be longer waiting times to speak with Court clerks, receiving Court Orders or files not progressing at the timescale we would have expected pre-Covid-19 it has been frustrating for both ourselves as well as our clients. However, we do know this is due to the current climate and the lack of physical staff that are working in the Courts at present.
However, here in the Ringrose Law Family Department we were able to join the HMCTS Portal pilot Scheme. This has allowed us to complete a variety of Court tasks through an online Portal which makes them a lot more efficient. Before the current pandemic a simple divorce with no disputes submitted to the Court by post would take between 6-9 months, a simple divorce by post now will take at least 9-12 months. When using the Court Portal a simple divorce can be completed within 6 months dependant on parties agreeing to all stages of the divorce as soon as they are notified.
Another area in which the Court Portal can be used is Financial Consent Orders. Before the pandemic, once both parties had agreed to a settlement that both were happy to agree to, we would send a draft Consent Order to the Court for Sealing. We would allow 6 weeks for this to be completed and returned, however, with the use of the Portal, a Draft Consent Order can be submitted and approved in as little as 4 days!
