Will Reviews Solicitors will always tell you that Wills should be regularly reviewed, I will normally say to a client: ‘remember to review your Will, at least every five years or if anything nice or horrible happens’. This is not something to forget, remembering to review a Will could save a family a lot of heart ache and resentment.

For example, a ‘nice’ thing to cause a client to review a Will would be their marrying a new partner. Not many people realise that marriage revokes an existing Will and the failure to review a Will could mean that that person’s estate would pass in its entirety to their new spouse and not to their children. A ‘horrible’ thing to happen would be that one person in a marriage or partnership goes into care. Again, whilst not a pleasant matter to think about, if the couples Wills provided for the survivor of them to inherit their estates or this was imposed by the intestacy regulations then all funds would be available for the survivor’s care home fees rather than passing for example to their children. Again at this stage it may be wise to change the contents of the Wills or indeed to put in place Wills to prevent this occurring.
