It is important you seek advice as soon as possible as legal action must be taken within three years (in rear cases you can exceed this) of the date you first knew, or could reasonably have been expected to know, that you have suffered an injury caused by someone else’s fault.
If the case involved a child, the three years begins to run from their 18th birthday.
Whilst the Court has discretion to allow cases to go ahead out of time, this is rarely exercised. You should always seek legal advice as soon as possible there, particularly as there is a vast amount of work to be done before bringing a claim for medical negligence.
