I was asked to attend Lincoln Police Station for a client arrested for an assault. The police officer dealing with the case informed what the allegation was and confirmed that if my client accepted what he had done, he would receive a police caution rather than be charged and taken to Court. I then spoke to my client who was happy to admit to the assault and receive a caution. However, I was not happy with this!

My client accepted punching the other person who had made the complaint, but he had only done so because the other person was being extremely aggressive and my client was scared and so hit out once and then ran away. I explained to my client that he was not guilty of any assault, he was only defending himself from what he thought was going to be an imminent attack. He had acted reasonably by not throwing any more punches and by leaving the scene. I therefore advised him to deny the assault during his police interview and following further representations by me to the police he was released without any action being taken against him.
