Steven Brooks, a member of our Personal Injury and Clinical Negligence Team, took conduct of Joanne’s case from another firm of Solicitors at the end of 2023.

Joanne suffered personal injuries as a result of a relatively straightforward road traffic accident that occurred in 2017. The vehicle in which she was driving was impacted from behind. Whilst some of her symptoms settled within a few months of the accident, she continued to experience problems in her right shoulder, neck and arm. Over time, these symptoms developed and started to impact on various areas of her life. She was in pain and discomfort which affected her home life and the ability to engage with her young children in certain activities. She was restricted in certain household tasks and chores that she could do – for example, DIY and gardening. The pain and discomfort impacted her work due to the need to take more regular breaks and take time off to attend appointments. She was unable to exercise as she had done previously. Understandably, the chronic nature of these issues also impacted her mood and mental health.

After seeing a variety of experts in differing fields of specialism, it was suggested that the ongoing problems may be due to a brachial plexus injury. The diagnosis was confirmed after seeing a Consultant Peripheral Nerve Surgeon. The Surgeon recommended decompression surgery to try and improve her situation. Surgery took place in 2023 but unfortunately was of little benefit. The situation following surgery was to be regarded as permanent.

There was a vast amount of documentation to consider from previous solicitors but It was important to get up to speed with where the case was at as quickly as possible.

Given the longevity of the claim, Joanne had become disillusioned with the claims process. It was important that Joanne was reassured and had confidence that the claim would reach a successful outcome and that she would receive the support and guidance to reach that point. It was therefore important to establish a good early rapport to affect the smooth transition from previous solicitors.

Having assessed the case, it was felt that there was nothing overly complicated or complex to prevent a settlement being achieved in a relatively reasonable time frame from the point in which we were instructed.

Settlement negotiations commenced in February 2024. The claim settled in March 2024 for the sum of £170,000.00.
