A package holiday should be a time to relax and enjoy a break from everyday life. Unfortunately, accidents, food poisoning and other illnesses can turn a much-anticipated holiday into a distressing experience.

What is a package holiday?

Under the Regulation, a package holiday is a holiday which:

  • Includes at least two of the below:
    • Transport
    • Accommodation
    • Any other services such as excursions or activities
  • Lasts for over 24 hours or includes overnight accommodation; and
    • Was paid for under one invoice to one company.

  • Food poisoning and associated illness
  • Slips, trips and falls
  • Swimming pool accidents; and
  • Defective or unsafe balconies;

 

What should you do if you are injured or become ill abroad?

If something goes wrong, there are several practical steps that you can take:

Seek medical attention

Your health should be your first priority. Obtain appropriate medical treatment and keep records of any diagnosis, treatment and medication.

Report the problem

Tell the hotel, tour representative or tour operator about the accident or illness as soon as reasonably possible.

Take photographs

If possible, take photographs of the accident location, any hazard or defect that caused your injury and your injuries.

Keep evidence

Retain booking documents, receipts, medical records, correspondence and other paperwork relating to the holiday and your accident or illness. Obtain contact details for any potential witnesses.
