What is Parental Child Abduction?
Parental child abduction happens when someone connected to a child takes them out of their home country without permission from;
- The other parent, or
- The courts.
If a court order states where a child lives, taking them out of the country without permission for more than four weeks could be abduction.
Under the Child Abduction Act of 1984, it’s a criminal offence for anyone connected to a child to take them out of the UK for more than 28 days without consent from the other parent or a court order.
Preventing Child Abduction – What to Do
If you think the other parent might take your child abroad without permission, you need to act fast. We can help stop this from happening. Our child abduction solicitors are ready to advise you on what steps to take.
If your child has already been taken abroad, we will work quickly to bring them back.
Getting Your Child Back From Overseas
If your child has been taken to a country in the EU or one that follows the Hague Convention, we can help you apply to have them returned. These countries usually agree that the courts in the child’s home country should decide where the child should live.
If your child has been taken to a country that doesn’t follow these agreements, we can help you make your child a "Ward of Court." We can also guide you on the laws of that country and how to get your child back. In some cases, we can even help seize the abductor’s assets or push for their arrest.
Have You Been Accused of Child Abduction?
If you’ve been accused of child abduction, you need legal help immediately. The courts can issue orders fast, even if you’re not there. You could also be asked to pay the other parent’s legal costs.
You must respond quickly. Courts can order banks, schools, or even mobile phone companies to give information about where you are. You might have only a few days to act, so it’s vital you contact us now.
If your child must return to the other parent, we can help negotiate the terms and, in some cases, stop criminal charges.
Can I Get Legal Aid for Child Abduction Cases?
Legal aid might be available for child abduction cases. We can help you check if you qualify.
