Under the new rules, couples no longer need to provide a specific reason or assign blame for the breakdown of their marriage. Instead, a simple statement confirming the irretrievable breakdown of the relationship is enough.

To apply for a divorce, you must meet the following conditions:

  • You must have been married or in a civil partnership for at least 12 months.
  • Your relationship has irretrievably broken down.
  • Your marriage (including same-sex marriages) is legally recognised in the UK.
  • The UK is your permanent home.

It is uncommon to attend court in person to finalise a divorce.

To ensure thoughtful consideration, there is a mandatory 20-week period between the initial application and the Conditional Order.

Known as the ‘Period of Reflection,’ this time gives you and your partner an opportunity to potentially reconcile before proceeding with the divorce.

There is then an additional 6-week period between the Conditional Order and the Final Order.

The timeline for your divorce can vary depending on factors such as:

  • Whether you and your partner can agree on dividing finances
  • Arrangements for your children, including who they will live with and visitation schedules
  • How quickly both parties complete and return the required paperwork

If disagreements arise or your financial situation is complex, the process may take longer.

Every divorce is unique. As such, the cost will depend on the work required to achieve a fair settlement between you and your partner.

If you and your partner are in full agreement, you can keep costs to a minimum. However, significant disagreements, particularly those that need court involvement, will increase expenses.

For uncontested divorces, we offer a fixed-fee divorce. This does not include standard court fees, payable separately.
