People often decide to apply for the Grant of Probate themselves, thinking this will save money. However, Wills are sometimes quite complicated and if you don’t get the right advice all that careful planning might go to waste. For example, people often like to use trusts in Wills as a way of protecting half of the value of the house if the survivor ends up having to go into care. For this to work though the trust needs to be properly completed after the death and for the house to be put in the name of the survivor and the trustees. If this is not done properly the council might still get its hands on the whole lot!
