    Conveyancing is the legal transfer of property, from one owner to another. It’s the job of a conveyancing solicitor to make sure the buyer gets the property for the prices they agreed on.

    The conveyancing process starts the moment when a seller accepts an offer made by a buyer. It lasts until the day of completion when contracts are formally exchanged, and the buyer gets the keys.

    In most cases, there are three main parts to buying or selling a house;

    1. The offer
    2. Exchange of contracts, and
    3. Completion

    When a seller accepts an offer from a potential buyer, the buyer (with help from their solicitor) should get as much information about the property as possible. This includes;

    • Reviewing all the information about the property, provided by the seller and/or estate agent. You will work with your solicitors to do this.
    • Conducting property searches, for example, local authority searches and environmental searches. Your solicitors will do this.
    • Get an independent survey to check the condition of the property. This is your responsibility.

    If the buyer isn’t happy with the checks, they can pull out of the sale.

    If the buyer is happy, they can apply for a mortgage and exchange contracts with the seller. The exchange of contracts makes the sale legally binding. No party will be able to pull out unless they can provide a valid legal reason for doing so.

    On completion day, the buyer’s solicitors send the money to the seller’s solicitor. The seller’s solicitor approves the transfer of deed which is then submitted to HM Land Registry. The seller has to move out on completion day and the buyer gets the keys.

    The buyer’s solicitor or conveyancer will also pay the stamp duty land tax.
