Official court figures indicate that the number of claims against executors for breach of duty have more than tripled over the past year.

The claims range from theft of assets by the executor to fraudulent distribution of assets to favour certain beneficiaries of the Will above others.

It has been reported that the increase in claims may be as a result of more people appointing friends or family members as executors of their Wills rather than solicitors in an attempt to keep costs down.  This may be a false economy.

Many perceive the task of executor to be simpler than it is.  Rather than placing all the responsibility on “amateur executors” clients would be well advised to consider the benefits of a joint appointment of a solicitor with a family member or friend.
