You do not necessarily need to contact a solicitor to get a divorce as most divorces are now done online through the court portal. However, there are potential difficulties to look out for which may mean you need help.

  1. Were you married abroad? You will need your original marriage certificate or a certified copy and a certified translation if not in English.
  2. Do you know where your husband/wife is? You will need a current address or email so that the court can send them a copy of the divorce application.
  3. Has your name changed since you got married? You will need proof of the change of name including for example, a Deed Poll or Change of Name Deed.
  4. Will your husband/wife cooperate with the divorce? You need to check this first before you start the divorce. You can apply jointly to start the divorce. If you cannot prove your husband/wife has received the divorce application, you may need to arrange personal or other forms of service so that the divorce can continue.
  5. Can the divorce be disputed? Unlikely unless there is a genuine legal reason. Not wanting a divorce and or wanting to delay it is not a good enough reason.
  6. What about arrangements for the children? The divorce process does not cover the arrangements so if you are concerned about them you may need to take some legal advice.
  7. What about a financial settlement? A divorce does not include a financial settlement even if you have come to an agreement between you. Any settlement needs to be approved by a judge as being a fair one. If you have pension provision you could lose out if you do not have court approval of any financial settlement before your divorce is completed. You may therefore need to take some legal advice.
  8. What if either I have difficulty with computers or the internet, or a disability or just do not have the time or patience to do it myself? You may need help either from the court or from a solicitor or other legal representative.
