The Criminal Injuries Compensation Authority (CICA) provide justice to victims of crime by compensating their injuries and financial losses. However, recent data from APIL paints a concerning picture about their compensation process.

An analysis of the 379 CICA cases that reached appeal in 2022/23 reveals an alarming trend of under-settlement. In those cases the average initial offer made by the CICA stood at a mere £7,848. Yet, following appeal, the average compensation award was £47,339, more than 6 times the initial award.

Such disparities beg the question: Are victims of crime truly receiving the fair compensation they deserve or are they being failed by the CICA.

The Risk of Going Solo: Why Legal Representation Matters

CICA’s official stance, and advice that is given at the outset of any CICA claim, is that victims do not need to engage legal representation and can pursue their claim themselves. This is a commendable, empowering and cost-saving aim, but one that leaves victims who choose to ‘go it alone’ paying a heavy price by losing out on significant compensation.

This may be because:

  • Victims lack the benchmark to discern whether the initial offer is fair and reasonable.
  • The appeal process, often including a face-to-face hearing, may seem overwhelming.
  • They may not possess the confidence, expertise, or resources to appeal the CICA’s decisions effectively.

Luckily recent criticisms raised by victims and supported by APIL’s findings have put the CICA’s procedures and empathy under the microscope.
