What are your employment maternity rights?
If you are pregnant you have various employment maternity rights and entitlements. These will include protection from dismissal and pay during your maternity leave.
Your main rights are as follows:
- As an employee you will be entitled to up to 52 weeks Statutory Maternity Leave.
- You will receive Statutory Maternity Pay provided you have been employed continuously for 26 weeks prior to the 15th week before your expected week of childbirth.
- Your contractual benefits, accrual of annual leave and employer pension contributions will continue throughout maternity leave.
- At the end of your Maternity Leave you have the right to return to your job. If a redundancy situation arises you must be offered suitable alternative employment if one is available.
If your employer fails to comply with your maternity rights you may have a claim. If you find yourself in this situation please contact one of our advisers to discuss as soon as possible. The Employment Tribunal has very strict time-limits for making maternity rights claims; usually three months less one day from the date of your complaint. It is therefore important you seek advice as soon as you can.
