Removal of Disqualification
If you have been banned from driving you can apply for a removal of disqualification and the return of your driving licence.
How soon can I apply for a removal of disqualification?
- Two years if you are disqualified for less than four years
- Half the period of disqualification if it is more than four years but less than ten years
- Five years if you are disqualified for ten years or more
How do I apply for the removal of disqualification?
You need to apply in writing to the court that disqualified you, giving the date of the offence, the conviction and information to justify your request.
What will the courts look for?
The courts will look at your record, to see if you have committed or been charged with any other offence. They will look at the nature of the original offence and take into account your character and how driving will impact on your life.
We can help you prepare this information, convincing the court that your licence should be reinstated.
Sometimes the court will be more persuaded if they are presented with medical evidence. For example, if you were convicted of drink driving or driving under the influence of drugs.
What happens if I am not successful?
If you are not successful then you have to wait three months before you can apply again for the removal of disqualification.
