How Long Do Claims Take?

How Long Do I Have to Make a Claim?

  1. The date of their death, or
  2. The date you became aware that they died because of medical negligence

Whichever is later.

There are two exceptions to this time limit;

  1. Claiming on behalf of a child – You can claim on a child’s behalf at any point up until their 18th birthday. After that, they have until they’re 21 to make a claim for themselves.
  2. Claiming on behalf of a person who lacks mental capacity – there are no time limits.
