How Much Compensation Can I Claim For Skin Cancer Misdiagnosis?

All misdiagnosed cancer claims are different.

The amount of compensation you’ll be able to claim will depend on your individual case.

When assessing your claim, consider;

  • The severity of your skin cancer
  • How long your skin cancer went undiagnosed
  • How much pain and suffering you’ve experienced
  • Past and future loss of earnings
  • The impact your cancer has had on your life
  • Any ‘out of pocket’ expenses you’ve incurred
  • The cost of any ongoing care, treatment, or support
  • Whether a loved one died as a result

How Long Do Claims Take?

The length of time it takes to settle you claim will depend on the severity and complexity of your case.

For us to claim the maximum amount of compensation, we need a full understanding of how the misdiagnosis has affected you and your life.

This can take time.

Settling too early could mean we claim less compensation than you’re entitled to.

However, if the other side accepts liability early on, we could claim early compensation payments.  This will help to cover the cost of immediate treatment and relieve any other expenses.

How Long Do I Have to Make a Claim?

There is a three-year time limit to file a skin cancer misdiagnosis claim. This starts from the date you became aware that negligence played a part in your misdiagnosis.

If you have lost a loved one to skin cancer, you have three years from;

  1. The date of their death, or
  2. The date you became aware that they died because of medical negligence

Whichever is later.

There are two exceptions to this time limit;

  1. Claiming on behalf of a child – You can claim on a child’s behalf at any point up until their 18th birthday. After that, they have until they’re 21 to make a claim for themselves.
  2. Claiming on behalf of a person who lacks mental capacity – there are no time limits.

This means you don’t have any financial risk. There’s nothing to pay upfront and there’s nothing to pay if your claim isn’t successful.
